Your privacy is a priority for diago.

We are committed to building a trusting relationship with our clients and pledge to protect the privacy of visitors and users of diago services in compliance with the amended French Data Protection Act of January 6, 1978, and Regulation 2016/679/EU of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

The purpose of our Privacy Policy is to inform you transparently about how we collect and use your data, as well as about your rights. By using diago services, you declare that you accept the terms of this Policy. This Policy may be modified at any time, and we therefore invite you to consult this page regularly.

1. Data Controller and Data Protection Officer

The Data Controller for your data is the company DIAGO, whose registered office is located at 14bis rue de l'Armée d'Orient, 75018 Paris - France. Diago commits to ensuring that all personal data processed by it is processed in accordance with the regulation relating to the protection of personal data.

2. Responsibility for Processing in the Context of Our Business and Services

- Description of our services: diago designs, distributes, and maintains conversational virtual assistants on behalf of companies of all sizes and sectors of activity.
- When diago makes its services available to its clients, it acts as the Data Processor for the latter, who remain the Data Controllers for the processing operations carried out during the management of their customer service.

3. What data is processed by DIAGO?
a) Data processed in connection with our websites

When navigating the website https://diago.ai/, certain personal data is processed, transmitted via the various forms present on the site, collected indirectly, or transmitted by you offline :
- Identification data (digital identifiers, last name, first name)
-Contact details (email, telephone)
- Cookies (which notably allow the IP address to be retrieved, see section 8 "Cookie Policy")

The contact form may require the following data to be processed:
- Your telephone number
- Your email address
- Your last name and first name
The time, date of appointment booking, and the reason for it are also processed.

b) Data processed in connection with the service demonstration on the website

Any person may request a demonstration of the services we offer our clients via our website. In connection with this operation, the following data is processed:
- Identification data (last name, first name, email, telephone number);
- Connection data;
- Any data subject to the conversation maintained with our conversational agent, including information that you voluntarily transmit to it. To this end, voice conversations may be recorded.

4. Why and on what basis is the data processed?
4.1. Purposes:
a) Websites

To provide an effective and relevant service during your navigation,
To contact you or provide you with information (e.g., demo of our software) if you have requested it via a form on the site or an email sent to the address contact@diago.ai,
To improve your experience when visiting our website.

b) Demonstration of our conversational agent

- To allow you to discover the operation and user experience of our customer request management service via our artificial intelligence-powered conversational agent.

c) Training of our algorithmic models

This purpose is to perfect our algorithms and thus improve the performance of our activities, particularly for the automated generation of voice responses for processing requests related to customer services.

4.2. Legal Bases for Processing

The data processing carried out by Diago is based on several grounds:

- Performance of a contract or pre-contractual measures (Art 6§1 b), GDPR)Thus, any request for contact or information, or any use of the service in the context of a demonstration, requires the processing of data necessary to respond to these various requests.

- Consent (Art 6§1 a), GDPR) which will be requested from you whenever necessary. This consent is notably required at the time of depositing cookies and other tracers that are not strictly necessary (see 8).

6. What are your rights?

In accordance with the regulations in force, you have various rights listed below. You can exercise one of these rights:

diago undertakes to respond to you as quickly as possible following receipt of your request. An email or letter will be sent to you:
- To confirm the reception of your request
- To confirm the effective compliance with your request

You also have the right to lodge a complaint with the Commission Nationale de l’Informatique et des Libertés (CNIL) (French Data Protection Authority), particularly on its website www.cnil.fr.

a) Right of Access

You can access the data processed by diago at any time. We will send you a file containing all of your data.

b) Right to Rectification

You may at any time request the rectification of inaccurate or incomplete data that diago holds about you, which may be visible, for example, after exercising your Right of Access.

c) Right to Object

If you wish to object to the processing of your data for commercial prospecting, you do not need to provide any justification, and Diago will cease processing your data.

d) Right to Restriction of Processing

You have the right to request the restriction of processing to storage only, for one of the reasons stated in Article 18 of the GDPR, namely:
The time required to rectify data in the context of exercising your Right to Rectification.I
f this data is still necessary for you to exercise legal rights.
The time required to verify the conditions of the Right to Object.e

e) Right to Erasure

You have the right to demand the erasure of your data as soon as possible, in the following cases:
- Your data is no longer necessary for the purpose for which it was collected.
- You withdraw your consent (when processing is based on this legal basis).
- You have exercised your Right to Object.
- In order to comply with a legal obligation.

However, please note that this Right to Erasure does not apply insofar as the processing is necessary for:
- The exercise of the right to freedom of expression and information.
- Compliance with a legal obligation which requires processing, provided for by Union law or by the law of the Member State to which we are subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in us.
- Archiving purposes in the public interest, scientific or historical research purposes, or statistical purposes.

We ask that you specify exactly which data you wish to erase from the data we hold.

diago will respond to your request within a maximum period of one month, in accordance with the regulations.

f) Right to Withdraw your Consent

For any processing based on your consent, you can withdraw it at any time.

7. How long is your data processed?

The data retention period may vary depending on the purposes.
- Data collected via our cookies: they are retained for 13 months.
- Data collected for the purpose of making contact: they are retained for 36 months.
- Data collected in the context of providing the service demonstration: they are retained for 36 months.

The collected data is processed only for specific purposes and deleted as soon as it is no longer necessary for contracts or the provision of our services. We ensure, whenever possible, that automatic deletion is implemented for the processed data, in order to ensure its effective removal and adherence to a predetermined duration that is proportionate to the purposes of the processing.

8. Cookies

Upon your visit to the Website, certain cookies may be placed on your device. A cookie is a small file that does not allow the identification of the User but records information relating to a computer's navigation on a website. The data thus obtained aims to facilitate subsequent navigation on the site, and is also intended to allow various traffic measurements, audience measurements, etc., to improve the quality of the site. Refusing the installation of a cookie may lead to the impossibility of accessing certain services.

The data transmitted by these cookies is retained for only 13 months, after which your consent will be requested again.
